People v. Anderson, 138474
Affirmed as modified, affirmed the death penalty of an automatic death penalty case. Defendant's appeal argued procedural and instructional errors as well as a challenge to the death penalty. The Court held that the errors were not prejudicial, but that the sentencing enhancement for a prior conviction was in error and should be corrected. The court struck the one-year enhancement for a prior prison term and directed the trial court to amend the abstract of judgment. The Court found the California death penalty as a whole provides adequate safeguards and is not arbitrary.
