Criminal death penalty case. Affirmed. Defendant was found guilty of first degree murder of a 12 year-old boy, special circumstances applied because the murder occurred during the commission of a lewd and lascivious act on a child. Penal Code section 187, 190.2, and 288. The jury returned a death verdict. The appeal was automatic. The California Supreme Court affirmed the judgment.
