Supreme Court of California

P. v. Chavez, 238929

Affirming the judgment of the Court of Appeal, but under a different rationale, in the case of a foreign national seeking to have the charges dismissed in a case where he had been sentenced to probation who claimed ineffective assistance of counsel that failed to inform him of the immigration consequences because the trial court exceeded the authority conferred by a section of the law permitting the dismissal of a case in the furtherance of justice because that law required the dismissal to occur prior to the completion of probation.
