Supreme Court of California

In Re Roy Butler, 237014

Reversing the Court of Appeal decision that statutory developments relating to the use of base terms in determining the release dates of inmates subject to indeterminate sentences did not relieve the board of separate obligations to calculate base terms under the agreement because such terms no longer related to sentences and also reversing the court's determination that base term calculations were necessary to avoid constitutionally excessive punishment because there were other mechanisms to prevent such problems.
