Supreme Court of California

K.R. v. Super. Ct., 231709

Reversing the appellate court's denial of a petition for writ of mandate in a criminal conviction because the Arbuckle rule generally holds that when a judge accepts a plea bargain an implied term is that the same judge will impose sentence, so a showing of expectation and reliance upon this condition by the defendant is unnecessary to invoke the rule.
