In a criminal case in which defendant was charged with making a criminal threat under Penal Code section 422, arising out of his display of gang-related and menacing hand gestures at a group of people that included an off-duty police officer, the Court of Appeals' judgment reversing the trial court's dismissal of the criminal threat allegations is reversed where, because defendant's conduct involved neither words or an oral utterance, it falls outside the purview of section 422.
