Perry v. Bakewell Hawthorne, LLC, 233096

In a suit in which plaintiff claiming he was injured in a fall on property owned by defendant and leased the co-defendant, the Court of Appeals' decision affirming the trial court's judgment sustaining defendant's objection to the introduction of declarations because plaintiff had failed to disclose the experts as required by Code Civ. Proc. section 2034.210, is affirmed where when the court determines an expert opinion is inadmissible because disclosure requirements were not met, the opinion must be excluded from consideration at summary judgment if an objection is raised.
