In an automatic appeal of death sentence for convicted by a jury of first degree murder, Pen. Code section 187(a), assault by a life prisoner with malice aforethought, section 4500, and custodial possession of a weapon, section 4502(a), the Court of Appeal's judgment is: 1) modified to strike the one-year enhancement imposed on the assault by a life prisoner count for personal use of a deadly weapon; but 2) otherwise affirmed in its entirety.
