In an automatic appeal of a death sentence for convictions of first degree murders, Pen. Code section 187(a), attempted murder, sections 187 and 664, assault with a firearm, section 245(a)(2), robbery, section 212.5(a), residential burglary, section 459, and conspiracy to commit robbery and burglary, the judgment of death isreversed because of the erroneous excusal of a prospective juror during jury selection, and the matter is remanded for a new penalty determination and reconsideration of the question of a restitution fine under the currently applicable statute. The judgment is affirmed in all other aspects.
