Supreme Court of California

McLean v. State of California, 221554

In a labor and employment action, brought by a retired deputy attorney general against her former employer for failing to promptly pay final wages as required by Labor Code sections 202 and 203, the Court of Appeal's judgment is affirmed where: 1) the relevant statutory provisions apply when employees retire in addition to when they 'quit'; and 2) plaintiff's decision to name the State of California as a defendant rather than the California Department of Justice is not a basis for dismissing the suit.
