In an action arising after defendant city condemned a 1.66-acre strip of defendants' property in order to build a road, the Court held the lawfulness of the city's dedication requirement, relied on in paying defendants the undeveloped value of the property upon condemnation, is a question for a judge instead of a jury. The Court remanded the case for further proceedings.
