Death sentence for murder during a convenience store robbery, in a case making its fourth appearance before the Court, is affirmed where: 1) the trial court did not abuse its discretion in permitting defendant to represent himself during a hearing on a motion to modify the verdict of death; and 2) the trial court did not improperly refuse to consider a prior judge's factual findings in the course of independently reviewing the record under Penal Code section 190.4, subd. (e).
