People v. Shazier, S208398
Court of Appeals' reversal of trial court's judgment that defendant must be committed for secure confinement and treatment as a sexually violent predator (SVP) under the Welfare & Institutions Code section 6600 is reversed, where: 1) defendant has served two separate prison terms for sex crimes against young boys, and each time he was released on parole he soon violated the conditions of parole and committed new offenses against young boys; and 2) the Court of Appeal erred in reversing the trial court judgment on grounds that defendant suffered cumulative prejudice from multiple instances of prosecutorial misconduct, as there was only one identifiable and clear instance of misconduct, and one other instance of arguable misconduct, neither of which rendered the trial fundamentally unfair.
