People v. Merriman, S097363

Conviction and capital sentencing of defendant for first degree murder in which numerous special circumstance allegations were found true, is affirmed, where: 1) a joint trial on all charges did not deprive defendant of his constitutional rights to a fair trial and due process; 2) the evidence supporting defendant’s sexual offenses, resisting arrest, and witness dissuasion counts was relevant to the murder count; 3) the trial court did not err by granting the prosecution’s challenges in excusing two prospective jurors; 4) evidence of defendant’s uncharged misconduct through testimony of his alleged victims was properly admitted; 5) a jury instruction to consider circumstantial evidence was not contrary to the requirement of proof beyond a reasonable doubt; and 6) the prejudice arising from any juror misconduct has been rebutted and defendant is not entitled to relief.
