Supreme Court of California
People v. McCurdy, S061026
Conviction and death sentence of defendant for first-degree murder and kidnapping with the purpose to commit a lewd act on a child are affirmed, where: 1) the jury found true the special circumstance allegation of kidnapping murder; 2) defendant’s contention that evidence of his long-term molestation of his sister was not relevant to the present case is unpersuasive; and 3) defendant presents no compelling reason for the Court to revisit the constitutionality of the California death penalty statute.
