Supreme Court of California

People v. Avila, S135855

Defendant's convictions and capital sentence for kidnapping, committing two counts of lewd and lascivious acts on, and then murdering the victim under the special circumstances of murder while kidnapping, and murder while committing lewd and lascivious acts on a child under the age of 14, are affirmed, where: 1) the trial court did not err in refusing to change venue from Orange County, nor were defendant's constitutional rights violated by said decision; 2) the trial court did not err in denying defendant's request for additional peremptory challenges after he exhausted his statutory allotment of challenges; 3) the trial court did not abuse its discretion in admitting evidence that defendant had sexually molested three girls; and 4) defendant's remaining contentions fail.
