Supreme Court of California

People v. Debose, S080837

Defendant's multiple convictions including first degree murder, attempted premeditated murder, and robbery, with special circumstances, and death sentence, are: 1) vacated in part, with regard to the the arson-murder special-circumstance finding because the arson did not involve an inhabited structure or property; but 2) otherwise affirmed, where: (a) the trial court did not abuse its discretion in restricting defense counsel's questioning of prospective jurors regarding the charged crimes; (b) the trial court did not abuse its discretion in determining that Juror No. 2 could not perform her duties as a juror and discharging her as a result; and (c) defendant's remaining contentions fail.
