In an automatic appeal in two death penalty cases, defendants' convictions and capital sentences for first degree murder, premeditated attempted murder, kidnapping, false imprisonment and related charges, are: 1) reversed in part with regard to the lying-in-wait special-circumstance findings as to both defendants; 2) stricken in part as to the firearm use enhancements found true as to defendant Hajek and replaced with deadly or dangerous weapon use enhancements; but 3) in all other respects, affirmed as to the death judgments.
