Supreme Court of California

People v. Montes, S059912

Defendant's convictions for first degree murder, kidnapping during the commission of a carjacking, carjacking, and being a felon in possession of a firearm, and capital sentence are: 1) reversed in part as to the count for carjacking and stayed as to the sentence imposed for kidnapping during the commission of a carjacking because the same act or omission shall not be punished under more than one provision of law; but 2) affirmed in all other respects, including the death sentence, where defendants multiple claims of error fail.
