Supreme Court of California

People v. Mai, S089478

Defendant's conviction for first degree murder of a peace officer and sentence of death, is affirmed, where: 1) defendant validly waived any conflict of interest arising from his counsel's connection to the federal case; 2) defendant fails to show any potential conflict of interest actually materialized or that any conflict of interest resulted in adverse performance by his counsel, or that counsel otherwise rendered ineffective assistance; 3) there was sufficient evidence supporting the special circumstance finding that he intentionally killed a police officer engaged in the performance of duty; and 4) defendant's multiple other challenges fail.
