People v. Rogers, S080840

Defendant's conviction for first degree murder and sentence of death are affirmed, where: 1) substantial evidence demonstrated prospective juror No. 3156's expressed reticence to deliberate on the penalty in a death case would prevent or substantially impair the performance of his duties as a juror; 2) the trial court did not err in admitting evidence of the uncharged Florida and Louisiana murders as probative on intent and common design or plan in the commission of the victim's murder; 3) there was no error in the instruction on flight to the jury; and 4) defendant's remaining challenges to the guilt and penalty phases fail.
