Supreme Court of California
People v. Davis, S198434
Evidence of methylenedioxymethamphetamine (MDMA)'s chemical name, standing alone, when that substance is not listed in the code, is insufficient to prove the material is a controlled substance regulated by the Health and Safety Code, and therefore, the Court of Appeal erred in concluding that sufficient evidence supported defendant's convictions for possession and sale of a controlled substance.
