People v. Linton, S080054
Defendant's conviction for first degree murder and related charges, and sentence of death are affirmed, where: 1) the trial court did not err in finding defendant's statements to the police were freely and voluntarily made and that there was no Miranda violation; 2) the trial court did not err in excluding evidence defendant claimed was relevant to defendant’s claim that he was coerced into making false admissions and confession; 3) the trial court did not err in failing to excuse Juror No. 1; 4) the trial court did not err in declining to instruct the jury that defendant’s unrecorded oral admissions should be viewed with caution; 5) there is no cumulative prejudicial effect of error; and 5) defendant's claims regarding the penalty phase fail.
