Jankey v. Lee, S180890

In plaintiff's civil rights suit against a grocery store owner for denying him and other similarly situated disabled person access to the full and equal enjoyment of the goods and services offered by the store, trial court's grant of defendant's motion for summary judgment and an award of attorney fees under section 55 is affirmed where: 1) the plain language of section 55 makes an award of fees to any prevailing party mandatory; and 2) the ADA does not preempt this part of the state's attorney fee scheme for disability access suits.
