Supreme Court of California
People v. Dungo, S176886
The Court of Appeal's reversal of defendant's conviction for second-degree murder, in concluding that defendant's confrontation right was violated, is reversed and remanded where the forensic pathologist's description to the jury of objective facts about the condition of the victim's body, facts he derived from an autopsy report prepared from another pathologist and its accompanying photographs, did not give defendant a right to confront and cross-examine the pathologist who prepared the report.
