People v. Riccardi, S056842

In an automatic appeal of a defendant convicted of first degree murders and sentenced to death, trial court's judgment is affirmed in part and reversed in part where: 1) judgment of death is reversed because the trial court erred by failing to conduct voir dire with respect to one prospective juror, whose written questionnaire reflected conflicting and uncertain views concerning the death penalty and her ability to serve; 2) because the trial court did not properly instruct the jury, the burglary special-circumstance finding and one of the two multiple-murder special circumstances is reversed; but 3) remaining judgment is affirmed in all other aspects.
