People v. Stanley, S185961
In a criminal vandalism case in which defendant in 2009 vandalized victim's 1975 Dodge Adventurer four-door, three-quarter-ton pickup truck, extensively denting it and damaging the driver's side rear door so badly that it could no longer be opened, the court of appeals order of restitution in the amount of $2,812.94, reflecting an automotive body shop's written estimate of repair cost, is affirmed even though victim only paid $950 for the truck. The decision reconciles the conflict between two opposite holdings in In re Dina V. (2007) 151 Cal.App.4th 486, and People v. Yanez (1995) 38 Cal.App.4th 1622.
