Supreme Court of California

United Teachers etc. v. L.A. Unified School Dist., S177403

In a dispute between a school district and a teacher's union arising out of the conversion of a public school to a charter school and the resulting attempt to compel arbitration of the collective bargaining agreement, the Court of Appeals' judgment is reversed where: 1) a court faced with a petition to compel arbitration to enforce collective bargaining provisions between a union and a school district should deny the petition if the collective bargaining provisions at issue directly conflict with provisions of the Education Code; and 2) under the Education Code, an arbitrator has no authority to deny or revoke a school charter.
