Supreme Court of California
People v. Mena, S173973
In a prosecution for assault with a deadly weapon and carrying a concealed dirk or dagger, in which the trial court denied the defendant's motion for a pretrial lineup, conviction is affirmed, where: 1) a defendant may, but is not required to, seek writ relief from denial of a lineup motion, and the failure to do so does not forfeit appeal; but 2) the Court of Appeal correctly concluded that the trial court's error, if any, was harmless.
