Supreme Court of California
People v. Thomas, S185305
In a prosecution in Madera County Superior Court charging the defendant with possession of cocaine for sale and possession of a firearm by a convicted felon, the Court of Appeal's determination that venue was improper is reversed, where venue in Madera County was proper under Penal Code section 781, since: 1) the defendant committed preparatory acts in Madera County and the effects of defendant's unlawful possession of the drugs and firearm found in a Fresno County storage locker would be felt in Madera County; and 2) permitting the case to be tried in Madera County satisfied the purposes of the venue requirement.
