Supreme Court of California
People v. Eubanks, S082915
In an automatic appeal from the conviction and sentencing of defendant to death for the murders of her four children, conviction and sentencing are upheld where: 1) defendant is not entitled to a reversal of the guilt or penalty verdict based on her forfeited preliminary jury screening claims; 2) the trial court properly denied defendant's motion to quash two search warrants and suppress the items located during derivative searches; 3) the admission of a rebuttal witness was not an abuse of discretion; and 4) evidence which casts doubt on defendant's ability to parent was properly admitted during the penalty phase under Evidence Code section 352.
