Conviction and sentencing of defendant for first-degree murder with the special circumstances of a murder committed while engaged in the commission of a lewd and lascivious act on a child under the age of 14, Pen. Code, sections 187, 190.2(a)(17), are upheld where: 1) trial court's evidentiary errors were individually and cumulatively harmless; 2) the lewd-and-lascivious-act special circumstance statute is constitutional; and 3) defendant's challenges to California's death penalty law and standard jury instructions are without merits.
