Supreme Court of California

People v. Sutton, S166402

Judgment of the court of appeal upholding the trial court's action in delaying trial in the underlying criminal proceedings is affirmed as the trial was delayed on a day-to-day basis for a brief period of time in order to permit one co-defendant's appointed counsel to complete an ongoing trial in another case that ran longer than had been anticipated and People v. Johnson, 26 Cal.3d 557 (1980), should not be understood to preclude a trial court from finding good cause to delay trial under the circumstances presented by this case.
