Supreme Court of California
Oakland Raiders v. Nat'l Football League, S132814
In a suit brought by the Oakland Raiders football team against the NFL arising from the Raiders' move to Oakland after development of a new stadium in the L.A. area did not proceed, a court of appeals decision reversing a grant of a new trial for the Raiders following an adverse jury verdict is affirmed where the Raiders failed to meet their burden of showing that the trial court should have granted the motion on the ground of juror misconduct. When a trial court grants a new trial on the ground of jury misconduct and properly specifies the ground for granting the motion, but does not provide a statement of the reasons for granting the new trial on that ground, an independent standard of judicial review applies.
