In the context of the bar against the execution of mentally retarded persons for criminal offenses and prejudgment determinations of mental retardation, a pretrial finding of mental retardation is appealable under Penal Code section 1238(a)(8). Further, in the murder case at hand, the trial court did not use an incorrect legal standard in making a finding of retardation.
