Philadelphia Indem. Ins. Co. v. Montes-Harris, S130717
If coverage under an excess policy is sold to a rental car customer in reasonable reliance on the rental car agent-s inspection of the customer-s driver-s license and signature, and if the insurer acts promptly upon discovery of the customer-s misrepresentation concerning the validity of the license presented, the insurer may be able to avoid liability on the excess policy to third parties injured by the customer.
