Soukup v. Law Offices of Herbert Hafif, S126715, S126864

Although defendants, litigants whose prior action was dismissed under the anti-SLAPP statute, may, in turn, invoke the statute as a defense to a subsequent "SLAPPback" action for malicious prosecution and abuse of process, plaintiff nonetheless demonstrated a probability of prevailing on her malicious prosecution claim so as to defeat defendants' motion to strike.
