Pilimai v. Farmers Ins. Exch. Co., S133850
The cost-shifting provisions of Code of Civil Procedure section 998 apply to uninsured motorist arbitration conducted pursuant to Insurance Code section 11580.2. Further, the "maximum liability" provision of section 11580.2 does not preclude recovery of costs under section 998 that, added to an arbitration award, exceed the coverage limits.
