PEOPLE v. VIEIRA, S026040

Conspiracy to commit murder is not a death-eligible crime. Death sentence as to this count reversed and remanded so that defendant may be resentenced to a term of 25 years to life imprisonment. Defendant-s death sentence as to other three counts upheld and judgment affirmed in all other respects.
