PEOPLE v. LEWIS, S020670

In a capital case where the original death sentence was vacated because the trial court erroneously considered a probation report in ruling on defendant's automatic application to modify the penalty, on remand the trial court denied the application for modification and reinstated the death sentence. The Supreme Court affirmed.
