PEOPLE v. PENA, S106906

The standard oral argument waiver notice of the Fourth District Court of Appeal, Division Two, has a real potential to interfere with a party's proper exercise of the right to present oral argument on appeal. Because the waiver notice in fact deterred defense counsel from requesting oral argument, the judgment is reversed.
