Supreme Court of California

PEOPLE v. BUTTRAM, S103761

The Court of Appeal was mistaken to conclude that a certificate of probable cause was necessary to assert an abuse of sentencing discretion within the maximum term established by a plea agreement, and so erred in dismissing defendant's appeal for lack of a certificate.
