SAN REMO HOTEL L.P. v. CITY AND COUNTY OF SAN FRANCISCO, S091757

Where plaintiffs' proposal to convert a hotel from residential to full-time tourist use constituted an expansion of the hotel's historical use, a conditional use permit was required, and requiring plaintiffs to pay an in lieu fee to a government fund for the construction of low and moderate-income housing was not a taking.
