De la Carriere v. Greene, 285793

Reversed award of attorney fees. The parties sued each other over a real estate deal. The trial court rendered a judgment for the Defendant and awarded him attorney fees as the prevailing party. Defendant appealed the award, claiming an error in the calculation of damages. That appeal was voluntarily dismissed. Plaintiff then sought an award of attorney fees for the dismissed appeal, which the trial court granted. The appeals court found that the trial court erred in granting Plaintiff attorney fees.
