Collins v. Thurmond, 075781

Affirmed in part. Reversed in part. Plaintiffs sued a number of defendants that included both local and state entities for causes of action alleging racial discrimination in disciplinary actions at a local high school. The appeals court affirmed the dismissal of most of Plaintiffs claims against state-level defendant because such claims cannot be brought against them. The appeals court did find that Plaintiffs have a cause of action under the equal protection clause of the California Constitution and they had standing to pursue the claims.
