Red & White Distribution v. Osteroid Enterprises, 291188
Reversed. Plaintiff appealed from a judgment entered against it after Plaintiff allegedly defaulted in settlement payments to Defendant. The appeals court concluded that the trial court erred in the amount of the judgment because a portion of it was unenforceable under CCP sec. 1671. Reversed in part and remanded to have trial court to reduce the judgment.
