Missionary Guadalupanas of the Holy Spirit v. Rouillard, 083232

Affirmed. This matter presents the issue of whether the Administrate Procedure Act was violated by Defendant when letters were sent to health care plans directing them to comply with California law in coverage of abortion services. The trial court rejected Plaintiff’s petition and complaint, stating that the letters represent a legally tenable interpretation of the law. Petitioner moved for a new trial based on admissions made by Defendant in a federal case. The trial court denied the motion. The appeals court found no abuse of discretion.
