Defendants previously appealed this case and the appellate court upheld the convictions, but remanded for sentencing to allow trial court discretion to strike a firearm enhancement pursuant to recently enacted Penal Code section 12022.53. On remand, the trial court denied Defendant’s motion to strike enhancement and the appeals court found no abuse of discretion.
