Plaintiff filed a motion to disqualify a judge under Code of Civil Procedure section 170.6. It was filed in conjunction with a writ of habeas corpus to challenge a Board of Parole Hearing denying parole. Appeals court denied the petition for a writ of mandate finding that the 170.6 challenge was not timely.
