Dismissed. At issue is whether defendants who make a plea deal must obtain a certificate of probable cause for resentencing under Senate Bill 1393. The courts are split and the California Supreme Court has taken up the issue, but there has been no decision as of yet. This appeals court determined that a certificate of probable cause is necessary and because Defendant did not obtain one, the appeal is dismissed.
